René Benko convicted of aggravated fraud and given two more years

The Innsbruck court acquitted the Signa founder on a separate hunting-rifle charge. The new verdict is not final and remains open to appeal.

René Benko was convicted of aggravated fraud on Thursday and sentenced to an additional two years in prison after an Austrian court found that he had deceived the family foundation of industrialist Hans Peter Haselsteiner through a false financial guarantee. ORF

The ruling at Innsbruck Regional Court updates the position at the opening of the trial on Wednesday, when the founder of the collapsed Signa property and retail group pleaded not guilty. The new sentence is additional to an existing, final 30-month prison term. If upheld, it would bring the combined sentence to four and a half years. Reuters via Yahoo Finance

Thursday's verdict is not final and can be challenged. The court also acquitted Benko of a separate insolvency-related fraud allegation concerning an €80,000 hunting rifle. That distinction matters: he was convicted in the guarantee case, not on both counts heard during the trial. dpa via Handelsblatt

A guarantee before Signa's collapse

The fraud case concerned a notarised guarantee given in November 2023, shortly before Signa Holding filed for insolvency. The court accepted the prosecution's account that Benko had used a false guarantee to cause a loss of approximately €5 million to the Haselsteiner foundation. ORF

The underlying transactions were more specific than a single €5 million transfer. In its June 12 indictment announcement, Austria's Economic and Corruption Prosecutor's Office, known as the WKStA, said representatives of the foundation had been induced to transfer approximately €3.3 million to Signa Holding and to refrain from reclaiming another approximately €1.7 million. Prosecutors alleged that Signa Holding and another company benefited improperly from the arrangement. Their case was that Benko urgently needed funding for the sporting-goods retailer SportScheck as the wider group struggled. WKStA / Austrian Ministry of Justice

Benko disputed the accusations. His defence challenged whether the foundation had suffered the loss necessary to establish fraud, according to ORF’s account of the proceedings. The two former business partners also gave different accounts of the guarantee: Haselsteiner said he would not have transferred the money without it, ORF reported. ORF

Acquittal on the rifle allegation

The second charge concerned whether Benko had hidden a valuable hunting rifle from creditors during the insolvency proceedings involving Signa Holding and his own business affairs.

The WKStA had alleged that concealing the asset prevented or reduced creditors' recoveries. The court did not find it proven that Benko had hidden the rifle from creditors and acquitted him on that count, according to German news agency dpa's report carried by Handelsblatt. dpa via Handelsblatt

Earlier sentence remains separate

The 30-month sentence to which Thursday's two-year term would be added arose from an earlier insolvency-fraud case. That sentence became final in September after neither the prosecution nor Benko challenged the latest ruling, according to ORF, citing the court's press office. ORF Tirol

Benko has been under electronically monitored house arrest since October. A court spokeswoman told dpa after Thursday’s ruling that he remained in pretrial detention, which he was allowed to spend in a private apartment with an ankle monitor. The new verdict therefore should not be read as confirmation that he was immediately returned to prison. dpa via Handelsblatt

The proceedings are part of the legal aftermath of Signa's collapse, which began with insolvency filings in late 2023. Thursday's decision resolves the guarantee and rifle allegations at trial-court level. It does not settle all of the investigations surrounding the group, and the new conviction remains subject to the appeal process. Reuters via Yahoo Finance
